User Registration Terms and Conditions

Welcome to San Diego Artist Network. We are a non-profit organization that connects San Diego area artists with businesses, spaces, and individuals looking to hire them. These Terms of Use (“Terms”) govern your use of our website at sandiegoartistnetwork.com (the “Site”) and the services we offer through it.

Please read these Terms before you create an account. When you register for an account, you confirm that you have read these Terms and that you agree to them. If you do not agree, please do not create an account or use the Site. Your continued use of the Site after registration means these Terms stay in effect for as long as you have an account.

1. Who We Are

San Diego Artist Network is operated by San Diego Art Directory, a California non-profit organization (“we,” “us,” “our”). You can reach us at tech@sandiegoartdirectory.com.

2. Eligibility

You must be at least 18 years old to create an account or use the Site. By using the Site, you confirm that you are 18 or older and able to enter into a binding agreement.

3. Accounts

Creating an account is free. To post listings, offer services, hire artists, or message other users, you need an account. You agree to:

Provide accurate, current information when registering and keep it up to date.
Keep your login credentials confidential. You are responsible for activity that happens under your account.
Notify us promptly at tech@sandiegoartdirectory.com if you believe your account has been compromised.

We may suspend or close accounts that violate these Terms.

4. Artist Membership

Publishing an artist profile, portfolio, or service listing requires a paid membership. Responding to job postings and messaging other users do not require a membership and remain free.

The membership fee is $35 per year. The current price is shown at checkout before you pay.
Membership does not renew automatically. It expires at the end of the term unless you renew it manually. We may send reminders, but keeping your membership active is your responsibility.
When a membership expires, your artist profile and listings may be hidden from public view until you renew.
Membership fees are non-refundable except where required by law. Because membership is a non-profit contribution that unlocks access rather than a purchase of a specific outcome, we do not offer partial refunds for unused time.
We may change membership pricing or benefits going forward. Any change applies to your next renewal, not to a term you have already paid for.

5. Our Role

The Site is a venue. Artists use it to showcase their work and offer services. Businesses and individuals use it to post opportunities and hire artists. When an artist and a hirer enter into an arrangement, that agreement is between the two of them. We are not a party to it.

This means:

Artists on the Site are independent. They are not our employees, agents, or contractors.
We do not guarantee the quality, safety, legality, or outcome of any work, service, lesson, workshop, or job arranged through the Site.
We do not screen or endorse users, listings, or job postings, although we may remove content that violates these Terms.
Any disputes about work performed, payment owed, scheduling, or conduct are between the artist and the hirer. We may, at our discretion, try to help resolve a dispute, but we are not obligated to and are not responsible for the outcome.
We do not process payments between artists and hirers. Payment for any work, service, lesson, or workshop arranged through the Site is handled directly between the two of you, off the Site. We do not hold, transfer, or guarantee those payments.
We are not responsible if a hirer does not pay an artist, or if an artist does not deliver work that has been paid for.

Some artists offer scheduled services and set their own availability on the Site. When you request a time and an artist confirms it, that is a scheduling tool for the two of you. It is not a purchase, and no payment is collected through the Site. Cancellations, rescheduling, and no-shows are between the artist and the hirer.

6. Listings and Content

Users can post content on the Site, including artist profiles, portfolios, service listings, job postings, messages, and reviews (“User Content”). You agree that your User Content will:

Be accurate and not misleading.
Be your own work, or work you have the right to post.
Not infringe anyone’s copyright, trademark, privacy, or other rights.
Not contain unlawful, hateful, harassing, obscene, or deceptive material.
Not include spam, off-topic promotion, or attempts to collect other users’ personal information.

Job postings must describe real opportunities. Service listings must describe services the artist genuinely offers.

We may edit, decline, or remove any User Content at our discretion, including content that violates these Terms or that we believe harms the community.

7. Your Content and Intellectual Property

You keep ownership of the content you post, including your artwork and portfolio materials. By posting content on the Site, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content on the Site and in materials promoting the Site and its artists (for example, featuring an artist’s work on our homepage or social media). This license ends when you remove the content or close your account, except where the content has already been shared as part of promotion or remains in copies made in the ordinary course of backups.

You may not copy, scrape, or reuse other users’ content from the Site without their permission.

8. Copyright Complaints

We respect the rights of artists and copyright owners. If you believe content on the Site infringes your copyright, send a notice to tech@sandiegoartdirectory.com including: a description of the work, the location of the allegedly infringing material on the Site, your contact information, a statement that you have a good-faith belief the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your physical or electronic signature. We will review and respond to valid notices, and we may remove content and terminate the accounts of repeat infringers.

9. Payments

Payments made to us are handled by a third-party payment processor, not by us directly. We do not receive or store your full payment card number.

Paying us. Membership fees and any other charges you pay to San Diego Art Directory are processed through WooPayments. WooPayments is operated by Automattic and processes card payments through Stripe, so when you pay us your payment information is handled by those providers under their own terms and privacy policies. We receive transaction details such as the amount, date, item, and billing contact information for record-keeping and support. You can review how these providers handle your information in Automattic’s privacy policy and Stripe’s privacy policy.

Payments between users. We do not process payments between artists and the people who hire them, and we do not take a commission on that work. Prices for services are set by the artists who offer them. When you agree to work together, you arrange payment directly with each other, off the Site. That includes deposits, cancellation terms, refunds, and rescheduling, which are between the artist and the hirer.

Because we are not part of those payments, we do not hold funds, issue refunds, or resolve payment disputes for work arranged through the Site.

Taxes. You are responsible for any taxes that apply to payments you make or receive. Artists are responsible for reporting their own income. We do not issue tax forms for work you arrange with other users, because those payments do not pass through us.

10. Reviews and Messages

Reviews must reflect your genuine experience. Do not post fake reviews, review your own listings, or trade reviews. Messages sent through the Site must relate to legitimate use of the Site and must not be used for harassment, spam, or solicitation unrelated to the Site’s purpose.

11. Prohibited Conduct

You agree not to:

Use the Site for any unlawful purpose.
Impersonate another person or misrepresent your affiliation with anyone.
Interfere with the operation of the Site, attempt to gain unauthorized access, or probe its security.
Use bots, scrapers, or automated tools to access the Site or collect data from it without our written permission.
Misuse the Site to defraud other users, or publish membership-only content without an active membership.

12. Third-Party Links and Services

The Site may link to third-party websites or rely on third-party services. We are not responsible for their content, policies, or practices.

13. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any listing, user, or transaction will meet your expectations.

14. Limitation of Liability

To the fullest extent permitted by law, San Diego Art Directory and its directors, officers, volunteers, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to your use of the Site or any transaction with another user. To the fullest extent permitted by law, our total liability for any claim related to the Site will not exceed the greater of one hundred dollars ($100) or the amounts you paid to us in the twelve months before the claim arose.

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless San Diego Art Directory and its directors, officers, volunteers, and staff from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Site, your violation of these Terms, or your dealings with other users.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.

If you have a problem, please contact us first at galina@sandiegoartdirectory.com and describe the issue. Most things can be sorted out directly, and we ask that you give us thirty days to try before taking any formal action.

If we cannot resolve a dispute informally, you and we agree that any claim arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in San Diego County, California, and you and we each consent to the personal jurisdiction of those courts. Either of us may bring a qualifying claim in small claims court in San Diego County instead.

Nothing in this section prevents either of us from asking a court for an injunction to stop ongoing infringement of intellectual property.

Disputes between users about work, payment, or scheduling are addressed in Section 5. We are not a party to those disputes.

17. Termination

You can close your account at any time. We may suspend or terminate your access to the Site at any time if you violate these Terms or if we reasonably believe your conduct harms other users or the Site. Sections of these Terms that by their nature should survive termination (including Sections 7, 13, 14, 15, and 16) will survive.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Site and update the effective date above, and we may notify you by email or a notice on the Site. Your continued use of the Site after changes take effect means you accept the updated Terms.
